Terms and conditions

These terms describe the general conditions of use of the services and content made available to the user by ANTILYA SRL through the website www.antilya.net  (the Web site").


The services and contents of this Website are made available to the user on the basis of these General Conditions of Use. Different, further or more specific terms and conditions may be applicable to other websites of ANTILYA Srl or to websites of integrated partners.
Access to or use of the Website and / or the service or content for which the user is registering implies acceptance of these General Conditions of Use (hereinafter referred to as "CGDU Document" or "DCGDU" ). If the user does not agree or does not intend to accept the terms and conditions of this DCGDU, the same user must not register or continue browsing the Site, or access its services or contents.

These general conditions of use apply to both consumers in compliance with Legislative Decree. 206/2005 of the Consumer Code, both to entrepreneurs, professionals and other economic subjects, unless it is expressly established that specific rules apply only to certain certain categories of subjects. Pursuant to current legislation (art. 3 of Legislative Decree 206/2005) we remind you that the "consumer" is the natural person who acts for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out.  

To accept this DCGDU, the user must have the power to enter into binding contracts in accordance with the law. By filling in any registration forms on this Website, the user declares to be of age and to have the capacity to act.

Except as expressly permitted by ANTILYA Srl in the access licenses to specific services / contents, it is not permitted to publish the Website Materials in newsgroups, distribution lists, electronic bulletin boards, educational sites, content aggregators, archiving services. files or any other online destination.
It is not permitted to reproduce illustrations, graphics, photographs, diagrams, portions of text, chapters or e-books included in the Materials.

6. End User Content.
 
6.1. End User Content Publishing.

ANTILYA Srl and its representatives reserve the right (but not the obligation), at its sole discretion, to refuse to publish or remove any content of the end user in the event that it may damage the image or rights of third parties or ANTILYA Srl, not be in line with the characteristics of the Website or the editorial lines of ANTILYA Srl.

6.2. Responsibility of ANTILYA Srl for user content.

ANTILYA S..rl. does not guarantee the accuracy, integrity or quality of the contents of the end user and assumes no responsibility for any errors, omissions, violations of the rights of third parties or illegal behavior deriving from the contents published, sent by email or otherwise transmitted via the website.
6.3. Use of end user content by ANTILYA Srl.

If the end user publishes his own contents, he authorizes ANTILYA Srl to memorize, archive, publish, transmit, use and distribute such contents to other users of the Website. The user acknowledges and accepts that ANTILYA Srl  reserves the right (but not the obligation) to retain such content: (a) for as long as the end user maintains an account with Pearson and for a period of 12 months thereafter; (b) for the time necessary to protect its rights in the event of a potential violation of these terms or a dispute concerning the contents of the end user and / or the account of the end user; (c) indefinitely, without reference to the user's personal data. You acknowledge and agree that ANTILYA Srl further reserves the right to disclose end-user content in combination with your personal data if required by law or if it believes in good faith that such disclosure is rightfully necessary for: ( a) comply with a legal process; (b) apply the terms set forth in this document; (c) respond to complaints regarding infringement of third party rights due to end user content; or (d) protect the rights, property or safety of Pearson, its users and the public.

7. Restrictions on the use of the Website. 
The user undertakes not to use the Website for the following purposes:
a) upload, publish, email or otherwise transmit any content that is not permitted under section 6 or that violates this DCGDU in any way;
b) impersonating another person or entity or providing false or otherwise incorrect statements regarding the relationship with a person or entity, for example using another person's login credentials;
c) upload, publish, email or otherwise transmit unsolicited or unauthorized promotional or advertising materials, junk mail, chain letters, "pyramid schemes" or other forms of reminders;
d) use or attempt to use "deep-link", "scraper", "robot", "bot", "spider", "data mining", "computer code" or any other process or methodology, algorithm, tool, automated program or device, or manual process with similar functionality or procedures, to access, acquire, copy or monitor parts of the Website, data or content available on the Website or any other ANTILYA Srl material without having obtained express written authorization from ANTILYA Srl;
e) obtain or attempt to obtain through any means any Materials, end user content, or any other data, content, software or code available on or through the Website that has not been intentionally made available to the public on the Website, or accessible via a link visible on the Website;
f) violate systems to limit or prevent access to the Website or its Materials or contents;
g) violate the protection of the Website or attempt to obtain unauthorized access to the Website, its Materials and contents, or to networks or computer systems connected to the Website services, through acts of computer piracy, misappropriation of passwords or any other means;

The user declares and guarantees to ANTILYA Srl

In the event that any provision of this DCGDU is declared invalid or unenforceable for any reason by a court of competent jurisdiction, the remainder of the DCGDU will remain valid and enforceable under its terms.
 
The user acknowledges that ANTILYA Srl could suffer irreparable damage as a result of the violation of this DCGDU or the unauthorized use of the Website and its contents and that, therefore, financial compensation may not constitute a sufficient remedy for this damage. 13. Law and competent court.
These General Conditions are regulated and must be interpreted and applied on the basis of the regulations in force in the territory of the Italian Republic.
 
Except in the case in which the user is a consumer, the only competent court for all disputes arising in connection with the execution of the DCGDU is that of the competent court based on the operational headquarters of ANTILYA Srl located in Cassano d'Adda, Milan.
If the user is a consumer, the competent judge remains the one provided for by Legislative Decree 206/2005.
